Terms and conditions

1. Acceptance

1.1. You acknowledge and agree that, by using or accessing the Studio you are indicating that you have read, and that you understand and agree to be bound by these terms, whether or not you have accepted these terms via our Site or by signing these terms either physically or electronically. If you do not agree to these terms, then you have no right to access or use the Studio.

2. Bookings

2.1. We do our best to ensure that the printed and published programme is as accurate as possible. In exceptional circumstances, we reserve the right to make last minute changes or cancellations. Wherever possible, we will advertise changes ahead of time, but there may be occasions where we are unable to do so. 

2.2. Prices are correct at the time of printing and ‘NRG Yoga + Pilates’ reserves the right to alter prices without prior notice according to market fluctuations.    

2.3. You are asked to arrive in good time for any appointment, class or event. We cannot guarantee your admission if you arrive late. 

2.4. Instructors have the right to refuse entry or ask you to leave if they feel that theirs, yours or another’s safety or enjoyment are being put at risk.

2.5. It is your responsibility to ensure that you are medically capable and have approval from your GP when participating in any activity at ‘NRG Yoga + Pilates’. All activities and treatments are undertaken at your own risk.

2.6. Any physical limitations that may affect your ability to participate must be fully disclosed and a Liability Waiver also completed confirming that you have sought medical advice when appropriate.

2.7. Classes, hire and bookings are subject to availability, but we will always do our best to accommodate your chosen class, event, date and time. 

2.8. Capacities for classes and events are limited. We operate a ‘first come first served’ booking policy. Pre-purchased online bookings take priority over drops in. 

2.9. Teachers are subject to change without notice. Wherever possible, we will advertise changes ahead of time.

2.10. Anyone participating in a class or event that is under the age of 18 years must have consent in writing from a parent or guardian. 

2.11. Purchases of sessions, classes, events or bookings are non-refundable and non-transferrable. Members and guests must not transfer any purchases to another person or permit them to be used by anyone other than themselves. Any assignment, transfer or disposal of purchases made is at the sole discretion of ‘NRG Yoga + Pilates’ and may only be permitted in exceptional circumstances.

2.12. Each person in class needs their own individual online account when booking any service.

3. Cancellations

3.1 Cancellation of class bookings made within a single class or a class package 

3.1.1 We operate a 24 hour cancellation policy for class bookings made with a single class or a class package.

3.1.2. Early cancellations (up to 24 hours before the start of class). Class bookings can be cancelled up to 24 hours in advance online. The class will be automatically credited back to the original account.

3.1.3. Late cancellations (within 24 hours of the start of class). We understand that cancellations are sometimes unavoidable – but cancelling late or not attending at all (no show) often stops other clients from booking places in that class and affects our business operation.

3.1.4. If a client fails to attend a scheduled class without providing such notice, the full cost of the session will be charged or, where a package of classes has been purchased, the session will be deducted from the remaining allocation. If you have any issues signing in online or had other difficulties that made you late cancel, or were absent for a reason we should know about please email info@nrgyogaandpilates.com.au as soon as you can.

3.2 Cancellation of class bookings made via auto-renew direct debits

3.2.1 We operate a 24 hour cancellation policy for class bookings made via weekly direct debits.

3.2.2. Early cancellations (up to 24 hours before the start of class). Class bookings can be cancelled up to 48 hours in advance online. The class will be automatically credited back to the original account.

3.2.3. Late cancellations (within 24 hours of the start of class). Cancellations made less than 48 hours before the scheduled class will result in the forfeiture of the booked session and a $15 cancellation fee.

3.3. Late cancellations (within 24 hours of the start of class). We understand that cancellations are sometimes unavoidable – but canceling late or not attending at all (no show) often stops other clients from booking places in that class. 

3.4. If a client fails to attend an appointment without providing such notice, the full cost of the session will be charged or, where a package of classes has been purchased, the session will be deducted from the remaining allocation. 3.5. We require that you sign into class a minimum of 5 minutes prior to the class start time. If you have not signed in by this time your space will be opened up to allow drop ins. If you arrive 10 minutes after the class has started you will not be able to attend the class and this will be treated as a late cancellation.

3.6. The rights of cancellation and refund and any other limitation expressed in this document does not affect your statutory rights as a consumer. Refunds in relation to products or services may only be credited to the debit or credit card originally used to make the purchase.

4. Packages and offers

4.1. Introductory offers can all be used once per person and cannot be used in conjunction with any other special offers or concession. Penalties may occur in the event that this offer is used twice.

4.2 Introductory offers are only available to new clients. If a client has visited our studio under any other pricing option or a third party provider they will not be eligible for these offers.

4.3 Any offers, class packs and monthly / annual memberships start from the date of the first class booked.

4.4. All pre-purchased packages and memberships will expire within the validity periods stated at the time of purchase, if not used.

5. Use of studio

5.1. The Studio is a shoe free zone. All outdoor footwear should be removed and stored in the appropriate spaces provided before entering the studio.

5.2. No crockery, glass or breakable objects are permitted in the Studio.

5.3. No food is to be consumed in the Studio. We however encourage you to stay hydrated by bringing a water bottle to class.

5.4. Members and guests must not walk barefoot in the premises if they have verrucae or similar foot complaints.

6. Personal belongings

6.1. Where we have made storage available, we would remind you that all possessions are stored there at your own risk. We would ask that contents be removed by the end of the session. 

7. Behaviour, etiquette & conduct

7.1. Loud and abusive language is not welcome.

7.2. Out of consideration to all our clients, all mobile devices should be turned off or switched to ‘silent’ during class.

7.3. Classes start promptly at the advertised times. Attendees need to arrive in their comfortable clothes with pilates socks, towel, belongings stored in the allocated shelves and settle on their mat or Reformer ready for class.

7.4. When mats and equipment has been used, attendees will be required to wipe these down and clean them at the end of use and return them back to their allocated storage areas

7.5. Respect our neighbourhood. Please arrive and leave the studio in a prompt and quiet fashion without obstructing driveways.

8. Liability

8.1. ‘NRG Yoga + Pilates’ will not accept liability for any damage or loss to the personal property of any guest brought onto the premises.

8.2. All activities and treatments are taken at your own risk.

8.3. Neither NRG Yoga + Pilates nor their instructors shall be liable for personal injury sustained by visitors whilst on the premises, except insofar as it can be proven that this relates to the wilful act, neglect or default of NRG Yoga + Pilates or their instructors.

8.4. Members or guests who suffer an accident or injury on the premises must report the accident or injury and the circumstances in which it occurred to the Instructor immediately following the accident or injury.

9. Data protections, use of site & online security

9.1. ‘NRG Yoga + Pilates’ takes all reasonable steps to protect your personal information, however we cannot guarantee the security of any information you disclose online. By using the ‘NRG Yoga + Pilates’ website you accept the inherent security implications of dealing online and will not hold ‘NRG Yoga + Pilates’ responsible for any breach of security unless such breach has been caused by ‘NRG Yoga + Pilates’s negligence.

9.2. By using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

9.3. You agree to use our site in accordance with these Terms and Conditions, only for lawful purposes and in a way which does not infringe the rights of anyone or restrict or inhibit anyone’s use and enjoyment of the site. If you do not comply with these terms, we may deny you access to our site.
